1. Account eligibility
To use the Services you must be at least the minimum age required to enter into a binding contract and use financial services in your jurisdiction, and you must be legally able to agree to these Terms. You must provide accurate, complete and current information when creating your account and keep it up to date. You may not create an account if you have been previously suspended or removed from the Services.
2. Acceptable use
You agree to use the Services only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the platform. You must not misuse the Services, interfere with their operation, attempt to gain unauthorised access, or use them in a manner that could damage or impair the platform. You are responsible for all activity under your account.
3. Digital asset and transaction risks
Digital assets can be highly volatile, illiquid and subject to sudden and significant changes in value. Transactions on public blockchains are generally irreversible, and once submitted they may not be cancelled or reversed. Network conditions, congestion and errors can affect the speed, cost and success of a transaction. You acknowledge that you use the Services and transact in digital assets at your own risk, and that you may lose some or all of the value involved. Tunda does not provide financial, investment or tax advice.
4. Third-party providers
Parts of the Services are delivered through integrated third-party providers, such as digital asset exchange and swap infrastructure, authentication and payment services. These providers operate under their own terms, policies and technical constraints, which may affect the availability, rate, success and timing of a transaction. Tunda is not responsible for the acts or omissions of third-party providers, and you should review their terms where applicable.
5. Fees and rates
Using the Services may involve fees set by Tunda, by third-party providers, or by the underlying networks. Fees, exchange rates and estimated receive amounts are shown before you confirm a transaction and may change based on market and network conditions. Network fees are set by the relevant blockchain and are outside Tunda’s control. You are responsible for reviewing all applicable fees and rates before proceeding with a transaction.
6. Transaction finality
Once a digital asset transaction is submitted to a network, it is generally final and cannot be reversed, cancelled or refunded, even in cases of error, mistaken address or fraud. Estimated receive amounts are indicative and may differ from the final result due to network conditions, provider processing and market movements. You must verify all transaction details, including addresses, networks and memos, before confirming.
7. Prohibited activities
You must not use the Services for any unlawful, fraudulent or abusive purpose, including money laundering, terrorist financing, sanctions evasion, market manipulation, or any activity that violates applicable law or the rights of others. You must not attempt to circumvent any controls, limits or security measures, or use the Services in connection with prohibited goods or services. We may report suspected unlawful activity to the relevant authorities.
8. Service availability
We strive to keep the Services available but do not guarantee uninterrupted or error-free access. Availability may be affected by maintenance, updates, network conditions, provider outages, legal requirements or events outside our control. We may modify, suspend or discontinue features with or without notice. We are not liable for any loss arising from unavailability of the Services.
9. User responsibilities
You are responsible for keeping your credentials secure, for all activity under your account, and for providing accurate information. You must promptly notify us of any unauthorised access or security concern. You are responsible for any tax obligations arising from your use of the Services and for complying with the laws of your jurisdiction. You must not share your account or allow others to act on your behalf without authorisation.
10. Limitation of liability
To the fullest extent permitted by law, Tunda and its providers are not liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, data or digital assets, arising from your use of or inability to use the Services. Our aggregate liability for any claim is limited to the amount you paid us for the Services giving rise to the claim, or where no amount was paid, to a nominal sum. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Suspension and termination
We may suspend, restrict or terminate your access to the Services if you breach these Terms, if we are required to do so by law, or if we believe your activity poses a risk to the platform, other users or third parties. You may close your account at any time. On termination, certain obligations, such as those regarding fees, liability and prohibited use, will survive. Transaction records may be retained as described in our Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be communicated through the Services or by email where appropriate. Continued use of the Services after a change takes effect means you accept the updated Terms. If you do not agree to the updated Terms, you should stop using the Services.
